The Topeka City Council late Tuesday approved a lease purchase agreement in the amount of $3,857,239 to acquire an enterprise resource planning software system from Lawson Software.
Council members voted 6-2 to make the move, with John Alcala and Sylvia Ortiz dissenting and Brett Blackburn being absent.
The vote came after city and Shawnee County staff members teamed up late last year to seek proposals from providers of ERP financial software but chose different vendors. County commissioners voted July 29 to buy an ERP system from SunGard Bi-Tech, LLC.
Commissioner Vic Miller suggested in early July that the city staff, by choosing Lawson, tried to short-circuit any possible merger of city and county information technology services. City staff members disputed that, saying they chose Lawson because its software best fit the city's needs. A city staff member told the council a merger remained possible if the city and county chose different companies.
The council on Aug. 28 voted to approve the purchase from Lawson and on Sept. 4 overrode Mayor Bill Bunten's veto of that move.
The measure the council approved Tuesday authorizes the city to spend $3,340,428 in principal and $516,811 in interest to buy an ERP system. The budget the council previously approved calls for an additional $400,000 for the project to come from the city's general fund.
Also on Tuesday, the council voted 8-0 in a work session preceding its regular meeting to take up a claim at its Oct. 2 meeting filed by Mount Carmel Missionary Baptist Church, 610 S.E. Lime. The church is asking the city to pay $62,938.72 for damages it sustained during flooding on May 7.
Three church members asked the council to approve the claim Tuesday after council members learned the city attorney's office recommends the city not pay the church's claim and 32 others linked to the flooding because they were caused by a natural disaster over which the city had no control and bears no legal responsibility. City attorney Brenden Long said the council could approve the claim if its members disagree.
Long said the city did pay damages for two claims linked to the May 7 flooding response. He said one was to a person whose boat went missing after rescue workers used it and the other to someone whose parked vehicle was struck by a city-operated high-loader.
In other business, the council on Tuesday:
n Voted 8-0 to approve a $500,000 project to build handicapped- accessible sidewalk ramps to meet requirements of the Americans with Disabilities Act, focusing on a target area located between S.W. 6th and 17th streets, S.W. Washburn Avenue and S.W. Topeka Boulevard.
n Voted 8-0 to approve an ordinance changing zoning to enable Jackson Memorial Church of God in Christ to build a three-story, 60- unit apartment complex and 11 single-story duplexes for senior adults in combination with church, day care and community center uses at 2401 S.E. 11th.
n Voted 7-1, with Councilman Jack Woelfel dissenting, to defer action for one week on a proposed conditional-use permit that would allow Ellite Investments to replace a billboard sign posted on a 35- foot pole with a sign of the same size on a 50-foot pole. The sign is located on land just east of S.W. Interstate 470 and south of the Cracker Barrel restaurant, 1421 S.W. Ashworth Place.
